Overview

ZirqArt (“we” , “us”, “our”) provides a services for browsing, selling and purchasing original artworks created by Ukrainian artists (“Artworks”) on our website (“Platform”).

These Buyer’s Terms & Conditions (“Agreement”), together with the General Terms of Use and all of ZirqArt’s terms and policies that you may enter into with us, govern your use of ZirqArt’s Platform as a Buyer (“you”, “your”). By accessing or using the Platform, you agree to be bound by this Agreement. If you do not agree with any part of this Agreement or cannot comply with it for any reason, you must not use the Platform.

Throughout this Agreement, words in the singular include the plural and vice versa, and words denoting any gender include all genders, as the context requires.

ZirqArt reserves the right to update or change these Buyer’s Terms & Conditions at any time. Any changes will be effective immediately upon posting to the website. We encourage you to review this Agreement periodically for changes. Your continued use of the Platform after the posting of any changes constitutes acceptance of those changes.

1. Account Registration

1.1. In order to make purchases on the Platform, you must create an account and complete the registration process as a Buyer. Please note that purchases can be made by individuals or entities. Please note that you are eligible to register as a Buyer only if you are not located and/or a resident: (i) in a country embargoed by the United States, and you are not on any United States government list of prohibited or restricted parties; (ii) in Russia or Belarus; (iii) in territories of Ukraine which are temporarily not under the control of the Ukrainian government or temporarily occupied by Russia.

1.2. Information from your registration form on the Platform (or any portion thereof) might be publicly visible on the Platform to any user.

2. Legal Capacity

2.1. By using the Platform and entering into transactions as a Buyer, you affirm that you have the legal capacity to enter into binding contracts under the laws of the jurisdiction in which you reside, but in any case, you must be at least eighteen (18) years old.

2.2. If you are using our Platform as a Buyer on behalf of an entity, you represent and warrant that you are authorized to bind that entity to these Agreement.

3. Purchases and Payments

3.1. By placing an order on the Platform, you are offering to purchase the Artworks listed for sale at the indicated price, subject to availability and this Agreement.

3.2. All prices are listed in US dollars and are exclusive of applicable taxes. Any purchases shipped internationally may be subject to further export, import and customs duties or international taxes. If any expenses arise on the side of the buyer, you are solely responsible for covering them. These charges may be added to your order total or be subject to separate payment and be invoiced directly.

3.3. You are solely responsible for paying any taxes and/or duties applicable to you as the buyer of the Artwork. These expenses are non-refundable.

3.4. You are solely responsible for any credit card company or digital payment platform commissions and fees incurred in relation to payments. These expenses are non-refundable.

3.5. The form of payment is prepayment.

3.6. You agree to pay for all orders placed through your account, and you authorize ZirqArt to charge your chosen payment method for the total amount of the order.

3.7. ZirqArt accepts payments through the following methods: Visa, Mastercard, and PayPal. By using any of the above payment methods, you agree to abide by the terms and conditions of the respective payment processors. ZirqArt reserves the right to add or remove accepted payment methods at its discretion without prior notice.

4. Artwork Descriptions and Representations

4.1. ZirqArt strives to provide accurate and detailed descriptions of the Artworks listed on the Platform. However, we do not warrant that the Artwork descriptions or other content on the Platform are accurate, complete, reliable, current, or error-free.

4.2. The images of the Artworks on the Platform are for illustrative purposes only. Please note that actual Artworks may vary slightly in appearance, e.g. Artworks may appear differently depending on lighting conditions, and/or details such as visible brushstrokes may not be fully evident in artwork images; and/or Artworks may contain artistic or incidental details that are not fully captured in the images provided, etc. These are not to be considered as defect in quality.

5. Order Cancellation

5.1. Please make your purchases wisely. You may cancel your order only if the Seller has not proceeded with the shipment of your purchase within 3 business days of receiving an order confirmation. You must inform us of your decision by providing a clear statement by submitting a return request by emailing at tatianagold@zirqart.com.

5.2. Each cancellation request is unique, so we will directly communicate with you to resolve the issue in the best possible manner. We reserve the right to make decisions on a case-by-case basis at our sole discretion.

5.3. ZirqArt can cancel your order within 24 hours. In that event, ZirqArt will notify you on the Platform and refund entire Purchase Price immediately.

6. Returns and Refunds

6.1. By placing an order, you agree to abide by the terms of our Return Policy [link].

7. Notification of Receipt and Non-Delivery

7.1. Upon delivery, you should thoroughly inspect the parcel for any signs of damage or discrepancies.

7.2. If Artwork arrives with damage that was not described or photographed in the listing, you should notify us promptly (no later than within 24 hours of delivery) by emailing at tatianagold@zirqart.com and fully complied with the shipping carrier’s (mail service’s) damage notification procedure. In the other case, we reserve the right to make decisions on a case-by-case basis at our sole discretion.

7.3. ZirqArt accepts no liability for Artworks lost in transit on their way to the Buyer. However, if you do not receive the order within the estimated timeframe, please notify us promptly by emailing at tatianagold@zirqart.com. Upon notice of non-delivery, ZirqArt will investigate the matter and may decide to issue a full refund to the Buyer. Such a decision is made individually at our sole discretion.
