Refund and Cancellation Policy
We want you to be completely satisfied with your purchase from ZirqArt (“we”, “us”, “our”). If you (“your”) have any concerns about your order, please review our Return Policy below.
Throughout this Policy, words in the singular include the plural and vice versa, and words denoting any gender include all genders, as the context requires.
ZirqArt reserves the right to update or change this Return Policy at any time. Any changes will be effective immediately upon posting to the website. We encourage you to review this policy periodically for changes. Your continued use of the Platform after the posting of any changes constitutes acceptance of those changes.
1. Return Policy
1.1. If you decide to return a purchase that you made on ZirqArt, for any reason, you can return it within 7 days after receiving the Artwork (“Return Terms”).
2. Eligibility for Returns
2.1. To be eligible for a return, Artwork must be unused, undamaged, and in the same condition that you received it.
2.2. Only regular priced Artworks may be refunded.
2.3. Certain types of Artworks are non-returnable, including: – Artworks on sale; – Custom-made or personalized Artworks; – Artworks damaged due to your misuse or negligence.
2.4. If you return Artwork that does not meet the eligibility criteria as prescribed in Article 2 above, ZirqArt reserves the right not to refund your purchase.
2.5. No exchange is available.
3. Initiating a Return
3.1. To initiate a return, you must inform us of your decision by providing a clear statement by submitting a return request on the Platform at [button //path] within the Return Terms.
3.2. If the Return Term has not expired, your request will be considered immediately, and you will receive personalized, detailed instructions on how to set up the return. Please carefully follow these instructions to ensure a smooth return process. It is your responsibility to send the Artwork you wish to return with the shipping carrier (mail service) before the Return Terms has expired.
3.3. As soon as the Artwork is sent, you must promptly inform us that the return process has commenced and provide scanned copies of shipping carrier (mail service) receipts and parcel tracking numbers by emailing at tatianagold@zirqart.com. In the other case, we reserve the right to make decisions on a case-by-case basis at our sole discretion.
3.4. If you return Artwork outside the Return Terms or fail to follow all of our instructions or comply with the prescribed procedure, ZirqArt reserves the right not to refund your purchase, and you will receive a relevant notification.
4. Return Process Essentials
4.1. Before you initiate the return process, we kindly ask you to note that: – by ordering paintings on the Platform, you are supporting Ukrainian artists during these difficult times of war; your purchase contributes to the development of Ukrainian art; – ZirqArt cannot be held responsible for Artworks damaged or lost in return shipment; – you are responsible for the cost and risk of returning the Artworks; – please use the same type of packing materials; – we recommend using an insured and trackable mail service; – you must complete your return (send the Artwork back) within Return Terms; – you are responsible to ensure compliance with all relevant international and domestic transportation regulations and to provide accurate and complete documentation for the lawful transportation of the Artwork; – all return shipping costs must be covered by you, including transport, restocking, handling fees, duties, shipping insurance, etc.; – shipping costs, including outgoing or return shipping costs, are non-refundable, unless otherwise prescribed by this Return Policy or by any other ZirqArt’s terms and policies that you may enter into with us; – export, import and customs duties or international taxes related to your purchase and/or return are non-refundabe.
5. Proof of Return Requirement
5.1. ZirqArt is unable to issue a refund without actual receipt of the Artworks or proof of received return delivery.
5.2. Once your return is received and inspected, we will send you an email within 5 business days to notify you of the approval or rejection of your refund. If your return is approved, we will process your refund.
6. Refund Details
6.1. ZirqArt will refund entire Purchase Price, excluding confirmed Seller’s outgoing shipping costs (if applicable).
6.2. You are solely responsible for paying any taxes and/or duties applicable to you as the buyer of the Artwork and related to its return. These expenses are non-refundable.
6.3. You are solely responsible for any commissions and fees incurred from credit card companies or digital payment platforms in relation to payments. These expenses are non-refundable.
7. Refund Timeline for Returns
7.1. ZirqArt will reimburse you no later than 3 business days from the day of the approval of your refund. We will use the same means of payment as you used for the order. Please note that it may take some extra time before your refund is officially posted by your credit card company or digital payment platform.
8. Shipping Guidance Disclaimer and Transit Insurance Responsibility
8.1. You acknowledge that any postage or shipping guidance provided by ZirqArt in the form of help articles or support correspondence comes with no guarantee of safe transit if followed. If you do not secure transit insurance for any artwork before shipping it, you do so solely at your own risk.
